Terms of Service

Welcome to Chordy! These Terms of Service ("Terms") govern your use of the Chordy mobile application ("App") operated by LIM4 ("we," "us," or "our"). By downloading, accessing, or using Chordy, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By creating an account or using Chordy, you confirm that:
- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
- You have read and understand our Privacy Policy
2. Description of Service
Chordy is a worship song management application designed for iOS, iPadOS, and macOS. The App allows you to:
- Create, edit, and manage songs with chord notation
- Organize songs into set lists (Pro feature)
- Transpose songs to different keys
- Display formatted songs with chords positioned above lyrics
- Export songs to PDF format
- Sync your content across devices via your iCloud account
We reserve the right to modify, suspend, or discontinue any feature of the App at any time with or without notice.
3. Subscriptions and Billing
3.1 Subscription Tiers
Free Tier:
- Up to 10 songs
- Basic transpose functionality
- PDF export
- No set list management
Chordy Pro ($4.99 CAD/month):
- Unlimited songs
- Set list management
- All current and future Pro features
3.2 Payment Processing
Important: All subscriptions are processed and managed entirely through the Apple App Store. We do not handle any payment information, billing, or transactions directly.
By subscribing to Chordy Pro:
- Your subscription automatically renews monthly unless canceled
- You will be charged through your Apple ID account
- Payment is charged at confirmation of purchase
- Renewal charges occur 24 hours before the end of the current period
- You can manage or cancel your subscription in your Apple ID Account Settings
3.3 Cancellation and Refunds
All refund requests must be directed to Apple, not to LIM4.
To cancel your subscription:
- Go to iOS Settings → [Your Name] → Subscriptions
- Select Chordy and tap "Cancel Subscription"
- Your subscription remains active until the end of the current billing period
To request a refund:
Refund eligibility is determined solely by Apple according to their policies. We cannot issue refunds directly.
3.4 Free Trials and Promotional Offers
We may offer free trials or promotional pricing from time to time. These offers:
- Are governed by the specific terms disclosed at the time of offer
- Automatically convert to paid subscriptions unless canceled before trial end
- May be limited to new subscribers or one per user
4. User Content
4.1 Ownership
You retain all rights to the content you create in Chordy, including:
- Song lyrics with chord notation
- Set lists
- Any other original content you input
4.2 Your Responsibilities
When using Chordy, you are responsible for:
- Ensuring you have the rights to any copyrighted lyrics or musical content you input
- Using the App only for lawful purposes
- Respecting the intellectual property rights of songwriters and publishers
- Backing up your content (though iCloud sync provides automatic backup)
Note: Chordy is a tool for personal worship and song management. It is your responsibility to ensure compliance with copyright laws, particularly for public performances or distribution of copyrighted material.
4.3 Storage
All your content is stored in your private iCloud account via Apple CloudKit. We do not have access to, store copies of, or backup your content. Your content is subject to Apple's iCloud Terms and Conditions.
5. Acceptable Use
You agree not to:
- Use the App for any illegal purpose or in violation of any laws
- Attempt to reverse engineer, decompile, or disassemble the App
- Use automated systems (bots, scrapers) to access the App
- Interfere with or disrupt the App's functionality or servers
- Violate any copyright, trademark, or intellectual property rights
- Upload malicious code, viruses, or harmful content
- Share your account credentials with others
- Resell or redistribute the App or subscription access
Violation of these terms may result in immediate termination of your account without refund.
6. Intellectual Property
6.1 Chordy App
The Chordy application, including its design, features, code, graphics, and trademarks, is owned by LIM4 and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works of the App
- Remove any proprietary notices or labels
- Use our trademarks without written permission
6.2 Third-Party Content
Song lyrics and musical compositions that you input into Chordy may be protected by copyright owned by third parties (songwriters, publishers, rights organizations). Chordy does not claim any rights to this content and is not responsible for your use of copyrighted material.
7. Disclaimers and Limitation of Liability
7.1 "AS IS" Service
Chordy is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Fitness for a particular purpose
- Merchantability
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of content
7.2 Limitation of Liability
To the fullest extent permitted by law:
- LIM4 shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid for Chordy Pro in the 12 months preceding the claim
- We are not responsible for data loss, though we encourage iCloud backups
- We are not liable for third-party services (Apple, Firebase, iCloud) or their availability
7.3 iCloud Dependency
Chordy relies on Apple's iCloud service for data synchronization. We are not responsible for:
- iCloud service outages or interruptions
- Data loss due to iCloud issues
- iCloud storage limits affecting your ability to sync
8. Termination
8.1 By You
You may terminate your account at any time by:
- Deleting your account in the App settings
- Canceling your subscription through Apple (if applicable)
- Uninstalling the App
8.2 By Us
We reserve the right to suspend or terminate your access to Chordy at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Extended periods of inactivity
- Any other reason at our sole discretion
8.3 Effect of Termination
Upon termination:
- Your access to Pro features (if subscribed) will cease at the end of the current billing period
- Your authentication data will be deleted from Firebase
- Your iCloud data remains in your iCloud account unless you delete it manually
- No refunds will be provided for unused subscription time (unless required by law)
9. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of Chordy shall be resolved in the courts of Ontario, Canada.
10. Changes to These Terms
We may update these Terms from time to time. When we do:
- We will update the "Effective Date" at the top of this page
- Material changes will be communicated through the App or via email
- Continued use of Chordy after changes constitutes acceptance
If you do not agree to the updated Terms, you must stop using the App and cancel your subscription.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
12. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LIM4 regarding Chordy and supersede any prior agreements.
